Flip Menu Marketing

In addition to to the above terminology: "Menu Promotion", "Restaurant Menu Promotion" and "Menu Marketing" refers to the service providid by the Company on behalf of the client upon receipt of payment which currently consists of: Converting clients menu to a flip style 3D version, provide a branded domain name that points to the flip style 3D menu, posting a weekly link to the menu to two local community social media platforms to promote the Clients menu and provide the Client with a weekly analytics report. "Flip Style 3D" and "Flip Menu" refer to Company's provided (or created by Us) menu converted to a flip book style 3D version available online. "Branded Domain Name", "Brand Domain Nme", "Domain" and "Domain Name" refers to a domain that consists of either <yourcompanyname>.newmenu.link or <yourcompanyname>.tastymenu.link made available for the Company to use for promotion of the Flip Style 3D menu. "Client Link(s)" and "Client Menu Link(s)" refers to links provided by the Client that point to the Clients online platforms, for example the Cliet's website or the Client's table booking page. "QR Code" or "Quick Response code" referes to a two-dimensional matrix barcode that contains encoded information, in this case a link to the Client's Flip Style 3d menu.

The client agrees to provide:

(a) a pdf or similar format of the their menu that they wish to be converted to a flip style 3D version of the menu for promotion. Alternatively the client may request our service to produce a pdf menu for this purpose.

(b) Any clickable links the client requires displaying ot the Flip Style 3D menu.

Refund terms

In the event the client terminates the Menu Marketing service no pro-rata refunds will be issued.

In the event the Company terminates the Menu Marketing service a pro-rata refund will be issued for any un-used periods. We will make every attempt to give one months notice however we reserve the right to not be compelled to any time limit. An exception however is if we cancel the service due to the client breaching acceptable use of the brand domain name the we reserve the right to not refund any un-used periods

Brand Domain Name

The Client may choose either <yourcompanyname>.newmenu.link or <yourcompanyname>.tastymenu.link for their Brand Domain Name. However the Company is unable to guarentee the availabily of the Clients desired name but will always suggest a suitable alternative depending upon availabilty.

The client agrees that the brand domain remains the property of the Company; with the Company allowing the clients useage of the domain for promotional purposes while ever payment is made for the the menu marketing service.

The Company has the right to terminate the service if the client uses the brand domain name in a way that is deemed a breach of acceptable use by the company.

Examples of breaches include but are not limited to:

Using the brand domain name within content that the Company deems would or may bring the company into disrepute or goes against its core values.

Displaying the brand domain name on a website or platform that may bring the company into disrepute or goes against its core values.

The client is also responsible to inform the company if it believes a third party is using the brand domain in a manner that may go against our acceptable usage of the brand domain name.

If the Client is any doubt regarding if proposed usage would breach our acceptable usage of the brand domain then they should contact the Company, providing details of the intended useage. The client should retain any communications with he Company and in the event the Company advises the intended useage would be considered a breach, then if the client progresses the Company has the right to terminate the Menu Marketing service immediately and to have no bligations to refund monies relating to un-used periods previously paid for.

Menu Promotion

The Company will posti a weekly link to the menu to two local community social media platforms to promote the Clients Flip Style 3D menu.

The Client accepts that the promotion of the Flip Style 3D menu is not a guarentee of additional customers, bookings or profits and the Company cannot be held responsible if the menu promotion fails to see any change in these metrics.

Menu Hosting

The Company will host the Clients menu on the Company's secure servers.

The company will attempt to ensure that its servers remain online and in doing so give access to the Flip Style 3D menu.

However the the Client accepts that the Company is unable to guarentee 100% availability.

The Client accepts the Company cannot be held responsible for any loss or perceived loss due to this.

The Company agrees to monitor it's server's availabilty ensuring maximum uptime is observed.

Server Maintenance

The company may from time to time carry out maintenance to ensure optimum server efficiency which result in downtime. Where possible the Company will endevour to give the Client aa much warning as possible and to keep this to a minimum.

The Company cannot be held responble for any downtime cause by maicious third parties, for example denial of service attacks.

Analytic Reporting

The company will provide a weekly report report detailing visitors viewing the Clients Flip Style 3D menu and any clicks on the Clients links provided on the menu like Client website or booking page.

Client Link(s)

The Company will place the Client's link(s) on the online Flip Style 3D menu.

QR Code

The Company will provide the Client with a personalized QR code that when scans links to the Clients Flip Style 3D menu to use with the Client's promotional material.

Cookies

We employ the use of cookies. By accessing Your Smart Menu Link, you agreed to use cookies in agreement with the Your Smart Menu Link's Privacy Policy.
